Legal Counsel – Part-Time or Full-time Position

Tsawwassen First Nation (TFN) is a proud Coast Salish nation whose land base is located south of the Fraser River along the Salish Sea. TFN is a modern treaty First Nation under the terms of a Final Agreement with Canada and British Columbia that became effective in 2009. The Tsawwassen First Nation Final Agreement is the first modern urban treaty in British Columbia, and the first to be negotiated through the BC Treaty Commission process.
TFN is now going through a period of revival and renewal as we plan our future and work towards our goal of becoming a strong, self-sufficient and sustainable First Nation for present and future generations.  TFN Lands are no longer “reserve” lands under the Indian Act; TFN owns its lands in fee simple and operates within the BC Land Title system.

Position Summary
Reporting to General Counsel, Legal Counsel is responsible for advising the TFN government on a wide range of matters with a particular focus on commercial real estate leasing and development, regulatory interpretation and development, contract negotiation and drafting and other complex Treaty lands jurisdiction and rights matters.

Specific Responsibilities

  • Negotiate, review and draft complex subdivision and development agreements, works and services agreements, latecomer and front-ending agreements, capital project construction agreements, and other lands-related agreements
  • Provide legal support in respect of TFN’s revenue generating initiatives, such as development cost charges, community amenity contributions and real property taxation
  • Provide legal support on major land development projects, where TFN is acting in a regulatory capacity through the rezoning, subdivision and development permit process and/or as a property owner in the construction of buildings and infrastructure
  • Manage the drafting, registration and discharge of encumbrances
  • Build, support, and maintain a positive working relationship with governments, industry, and First Nation organizations


  • A LL.B or J.D. from a recognized law school along with current membership, in good standing, with the Law Society of British Columbia – minimum 3 year call
  • Extensive experience in contract drafting is essential
  • Technical knowledge of LTSA electronic filing system and BC Land Title system is preferable
  • Experience working with municipalities or other government agencies and reporting to government officials is preferable
  • Knowledge of Treaty First Nation land and rights matters is preferable
  • Excellent written and verbal communication skills, including a proven ability to manage conflict situations effectively
  • Strong organizational and analytical skills with proven ability to meet deadlines in a multiple task environment
  • Highly self-motivated and proactive, with demonstrated experience taking initiative to address challenges or realize opportunities
  • Able to work independently with minimal supervision

Working Relationships 
The Legal Counsel must establish and maintain effective working relationships with elected and appointed officials of Tsawwassen Government, TFN staff generally, and external consultants.

Working Conditions
Work is performed primarily indoors in an office environment.  Off-site travel may be required to attend meetings, committees, conferences and training events.
